The concept of personhood has been central to bioethics debates about abortion, the treatment of patients in a vegetative or minimally conscious states, as well as patients with advanced dementia. More recently, the concept has been employed to think about new questions related to human-brain organoids, artificial intelligence, uploaded minds, human-animal chimeras, and human embryos, to name a few. A common move has been to ask what these entities have in common with persons (in the normative sense), and then draw (...) conclusions about what we do (or do not) owe them. This paper argues that at best the concept of “personhood” is unhelpful to much of bioethics today and at worst it is harmful and pernicious. I suggest that we (bioethicists) stop using the concept of personhood and instead ask normative questions more directly (e.g., how ought we to treat this being and why?) and use other philosophical concepts (e.g., interests, sentience, recognition respect) to help us answer them. It is time for bioethics to end talk about personhood. (shrink)

This July 2020 issue of JME introduces a new section, “COVID-19 Current Controversies,” which will be a recurring section in each issue for the foreseeable future. This issue reflects on some of the most pressing ethical issues that have arisen roughly 6 months into the pandemic. Kathleen Liddell and colleagues examine important legal considerations at play in ventilator allocation decisions raised by the pandemic.1 They point out that ethics-based triage protocols that argue from the principle of “saving the most lives” (...) by withholding or withdrawing ventilators from certain patients could violate the law (U.K. and elsewhere). Patients’ legal rights are not suspended during this crisis, they remind us. The mere action of ventilator removal (extubation and proning) may constitute battery without consent, for example. Moreover, there may be problems with “evidentiary weakness” in some of the prognostic models used to inform such decisions. And, decisions that are inconsistent, subjective, and/or discriminatory may be deemed illegal. Those developing policies need to consider and consult various areas of law including criminal law (eg, murder, battery, negligence, manslaughter), human rights law, civil law (eg, battery, negligence, duty of care, consent), public and administrative law (eg, discrimination, case law), law on decision-making for incapacitated adults, professional regulations, and derogations from current law (eg, immunities and indemnities). Liddell et al offer 10 concrete, legally informed recommendations for those developing triage-policies to consider. Michael Parker and colleagues take on the issue of contact tracing using mobile apps and point out that such apps can enable people to emerge more safely from lockdowns, which provides a strong autonomy-based argument in favour …. This volume contains papers by a group of leading experts on Aristotle and the later Aristotelian tradition of Neoplatonism. The discussion ranges from Aristotle's treatment of Parmenides, the most important pre-Socratic Greek philosopher, to Neoplatonic and medieval use of Aristotle, for which Aristotle himself set guidelines in his discussions of his predecessors. Traces of these guidelines can be seen in the work of Plotinus, and that of the later Greek commentators on Aristotle. The study of these commentators, and the recognition (...) of the philosophical interest and importance of the ideas which they expressed in their commentaries, is an exciting new development in ancient philosophy to which this book makes a unique and distinguished contribution. This July 2022 issue of the JME contains several articles addressing ethical issues related to COVID-19 as well as reproductive ethics—a timely topic, given the leaked U.S. Supreme Court document, anticipating the overturn of Roe v. Wade. In their paper, “Behavioral Equipoise: A Way to Resolve Ethical Stalemates in Clinical Research, “ Peter Ubel and Robert Silbergleit (2011) propose that we adopt another principle, the principle of behavioral equipoise, whereby RCTs are also morally justified in cases where they are expected to address the controversy, disagreement, or behavioral resistance surrounding a particular treatment. Adopting this ethical standard would allow for research to move forward and, as a result, for the resolution of stalemates between clinicians who hold opposing (...) views. There are two points that I would like to make in terms of objections to Ubel and Silbergleit’s argument, and then I want to emphasize what I think is particularly valuable about their argument. First, I dispute the move from the claim that the principle of clinical equipoise creates (or does not resolve) stalemates to the conclusion that adopting the principle of behavioral equipoise would dissolve stalemates. My second objection concerns the distinctness of the concept of behavioral equipoise fromthe concept of clinical equipoise. That said, I do think that Ubel and Silbergleit make an important point, and that is that one cause of equipoise is the behavioral and psychological factors of those responding to data. (shrink)

An original examination of the relevance of behavioral economics for the practice of medical ethics.

In an April 2023 article in JAMA Pediatrics, ‘Life Support System for the Fetonate and the Ethics of Speculation’, authors De Bie, Flake and Feudtner critique bioethicists for practising what they call ‘speculative ethics’. The authors refer to a 2017 article that they published on the Extra-uterine Environment of Neonatal Development (EXTEND) system. This system was able to keep fetonatal (newborn, but in a fetal physiological state) lambs alive outside of the parent lamb’s womb for 4 weeks. The article has (...) been accessed almost 300 000 times and received significant media attention. It also resulted in an explosion in the bioethics literature about ‘the ethics of the artificial womb’. However, the authors bemoan, these ethics discussions focused largely on unrealistic use cases of the new technology—from elective shortening of pregnancies to complete ectogenesis. The authors dubbed these discussions as ‘a technically and developmentally naive, yet sensationally speculative, pipe dream’. The use case of the EXTEND technology that is most realistic involves supporting extremely premature newborns (23–24 weeks). Other probable uses include supporting infants in later gestational ages (25–28 weeks) with pathological conditions, potentially allowing for surgeries or other therapeutics to be delivered without imposing risks on pregnant patients. The phenomenon of ambivalence is an important one for any philosophy of action. Despite this importance, there is a lack of a fully satisfactory analysis of the phenomenon. Although many contemporary philosophers recognize the phenomenon, and address topics related to it, only Harry Frankfurt has given the phenomenon full treatment in the context of action theory - providing an analysis of how it relates to the structure and freedom of the will. In this paper, I develop objections to Frankfurt's account, (...) all revolving around the charge that his account contains a serious ambiguity between willing and identifying. With such objections in place, I then develop an analysis that avoids the difficulties and ambiguities that Frankfurt's analysis is prey to. I briefly distinguish ambivalence from other types of internal conflict. This paper aims to offer conceptual clarification on the phenomenon of ambivalence, which will then allow for discussions about the normative merits and demerits of ambivalence, the effects of ambivalence on autonomous action, and methods of resolution of ambivalence. In 1941, Gellhorn and colleagues reported experiments in which modest reductions of blood sugar were induced in hypophysectomized/adrenodemedullated (HA) rats by intraperitoneal injection of human blood. Based on the effects of intraperitoneal injections of known amounts of Lilly insulin on blood sugar in HA rats, Gellhorn estimated that the "insulin" content of normal human blood (collected two and a half hours "after luncheon") was 200uU/ml (Gellhorn, Feldman, and Allen 1941). However, discrepancies between measurements of plasma insulin concentration by in vitro (...) bioassays, which began in earnest in the late 1940s and early 1950s, and, beginning in 1960, by radioimmunoassay (RIA), intimated that insulin was not .. ArgumentThe main thesis of this paper is that Copernicus's avoidance of all admission that scripture was contravened inDe revolutionibusand his composition of its new Preface in 1542, as well as the non-publication of Rheticus'sTreatise on Holy Scripture and the Motion of the Earth, were influenced by the early information they received on the failure of the 1541 Regensburg Protestant-Catholic colloquy, among the major consequences of which were significant increases in the problems concerning publishing works which contravened scripture. This is supported (...) by examining Rheticus's first letter to Paul Eber in conjunction with the documents on the Regensburg colloquy and on censorship in Nuremberg, as well as with the existing literature on Copernicus and his context. In view of the main thesis, Copernicus's apparent dedication of the work to the Pope merits additional explanation, and the second thesis is that components of explanations for several aspects of those parts of the Preface that relate to the Papacy and to theologians can be provided via comparisons with previous diplomacy between Warmia and the Papacy which occurred or was being referred to during Copernicus's time. This is supported by examining these parts of the Preface in the light of a selection of the relevant documents. (shrink)

Policymakers, employers, insurance companies, researchers, and health care providers have developed an increasing interest in using principles from behavioral economics and psychology to persuade people to change their health-related behaviors, lifestyles, and habits. In this article, we examine how principles from behavioral economics and psychology are being used to nudge people (the public, patients, or health care providers) toward particular decisions or behaviors related to health or health care, and we identify the ethically relevant dimensions that should be considered for (...) the utilization of each principle. An analysis of the identity issues involved in facial allograft transplantation is provided in this paper. The identity issues involved in organ transplantation in general, under both theoretical accounts of personal identity and subjective accounts provided by organ recipients, are examined. It is argued that the identity issues involved in facial allograft transplantation are similar to those involved in organ transplantation in general, but much stronger because the face is so closely linked with personal identity. Recipients of facial allograft transplantation (...) have the potential to feel that their identity is a mix between their own and the donor’s, and the donor’s family is potentially likely to feel that their loved one ‘‘lives on’’. It is also argued that facial allograft transplantation allows the recipients to regain an identity, because they can now be seen in the social world. Moreover, they may regain expressivity, allowing for them to be seen even more by others, and to regain an identity to an even greater extent. Informing both recipients and donors about the role that identity plays in facial allograft transplantation could enhance the consent process for facial allograft transplantation and donation. Although I agree with Sabine Muller’s conclusion that we should first seek to find alternatives to amputation for patients suffering from Body Integrity Identity Disorder (BIID), I disagree with one of the major premises that she uses to argue for her claim. Muller argues that patients with BIID are likely not autonomous when they request that the limb be amputated. Muller’s argument that BIID suffers are not autonomous is flawed because she conflates philosophical conceptions of autonomy with the conception of (...) autonomy that is operative in the context of medicine. For a true Platonist the nature of the soul is, in a sense, unproblematic. So too is its status. It is an immaterial entity, with all the attributes that that entails, and it is independent of any body with which it might, from time to time, be associated. And yet this extreme dualism must be modified in some way or other, if any account is to be given of the life and activities of a man, or any other living thing, (...) at least some of which require a body for their exercise. The problems that produced are notorious. A great deal of theoretical and experimental work has yet to explain why living organisms utilize only L‐amino acids in proteins and D‐sugars in RNA and DNA. Also unknown is how a form of life based on asymmetric molecules evolved from an environment containing a racemic mixture of prebiotic molecules. Cognitive scientists have identified a wide range of biases and heuristics in human decision making over the past few decades. Only recently have bioethicists begun to think seriously about the implications of these findings for topics such as agency, autonomy, and consent. This article aims to provide an overview of biases and heuristics that have been identified and a framework in which to think comprehensively about the impact of them on the exercise of autonomous decision making. I analyze the impact (...) that these biases and heuristics have on the following dimensions of autonomy: understanding, intentionality, absence of alienating or controlling influence, and match between formally autonomous preferences or decisions and actual choices or actions. This article considers Hannah Arendt's posthumously published Lectures on Kant's Political Philosophy, lectures delivered at the New School for Social Research in the fall semester of 1970. By taking Arendt's highly provocative reading of Kant as a point of departure, the essay probes Arendt's own theory of judgment. Arendt frequently draws distinctions that prove untenable. If the faculty of judgment, in Arendt's words, has to do with one's “ability to make distinctions,” and yet her own distinctions continually falter, and that (...) in a text about judgment, then it seems that she thwarts her own discourse. More specifically, she complicates her assertions by staging something that she, in Kantian terms, describes as “enlarged thought”; she explores the subject of judgment from different perspectives and allows for perspectival plurality, thereby “wooing,” as it were, our consent. In so doing, Arendt, in thoroughly Kantian fashion, establishes judgment as a performative category that defies being taught and instead remains a matter of practice. (shrink)

In some views in the history, philosophy and social studies of chemistry, Joseph Priestley is at least as well-known and cited for his objections to the new chemistry and his promotion of his own late version of the theory of phlogiston, as for his early series of discoveries about types of air for which he had become famous. These citations are generally not associated with any detailed indications about his late work from 1788 onwards and his late phlogistic theory, of (...) which there has not been a detailed study. This paper undertakes a detailed study of Priestley’s late work on water and related airs. He put forward a theory to support which his apparatus and initial substances would have needed to exclude impurities altogether. His theory did not take into account the solutions to the difficulties with the experiment which had been comprehensively understood and published by the phlogistian Cavendish several years previously, and with which the Lavoisians were in agreement. Priestley readily and fundamentally changed his interpretations of experiments in order to support the theory he currently favoured, and he was highly selective about replying about the criticisms of any opponent. This detailed analysis shows many divergences between his own practices and aspects of his objections to the new chemistry, which have implications for those stances in the secondary literature which do not question his objections. Accordingly, this study has implications concerning the nature of chemistry and other sciences, how they do progress and how they should progress. (shrink)

It is common for philosophers from the Madhyamaka school of Indian Buddhist thought to offer a presentation of the two truths, ultimate truth ( param rthasatya ) and conventional truth ( sa v tisatya ), as a vehicle for presenting their views on the ontological status of entities. Though there is some degree of variance, generally ultimate truths are described as objects known by an awareness of knowing things as they are. Conventional truths are objects as conceived by a mistaken (...) awareness, one that superimposes a mode of existence onto objects that is not actually there. These two truths are contrasted (one is accurate; one is not) and used as a vehicle for understanding the ontological status of phenomena and the means by which they are known. ntarak ita (725-788 CE) was among the most important Madhyamaka thinkers in Indian Buddhist history, yet his presentation of the two truths has several features that signal its uniqueness. This paper will discuss two particular unique dimensions to ntarak ita's views on the two truths: his integration of aspects of Cittamatra/Yog c ra thinking, including the rejection of external objects, into his presentation of conventional truths, and the dynamic way in which conventional truths are not merely presented as objects of a mistaken awareness, but rather as an important soteriological step in the process of realizing the ultimate. This syncretic and dynamic integration of Yog c ra thought, where its ideas are fully engaged and incorporated into an over-arching Madhyamaka philosophical system is a key component to the thought of one of the most important, influential, and innovative figures in the late period of Indian Madhyamaka, and one which has yet to be fully acknowledged in secondary literature.
